These Terms of Service ("Terms") govern your use of the websites, games, applications and other products offered by Robokick ("Robokick", "we", "us") (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the Services for your own non-commercial entertainment and personal use. We reserve all rights not expressly granted.

Acceptable use

You agree not to:

• Copy, distribute, rent, lease, sell or sublicense the Services or any part of them.
• Reverse engineer, decompile, disassemble or attempt to derive source code or assets, except where the law expressly allows it.
• Modify, cheat, exploit bugs, use unauthorised software, or interfere with the normal operation of the Services or other users' use of them.
• Use the Services in a way that is unlawful, infringing, harmful, abusive or that violates the rules of a platform or store you access them through.
• Circumvent, disable or interfere with security, access control or purchase mechanisms.

Intellectual property

The Services, including software, artwork, characters, audio, music, text, trademarks and all other content, are owned by Robokick or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers ownership to you.

Your content

If a product lets you create, capture, upload or share content, you keep your rights in it and you are responsible for it. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content to the extent needed to operate and provide the Services, and to remove content that breaches these Terms.

Purchases

Where a product is paid or offers purchases, the transaction is processed by the store or platform you buy through, and that store's terms, billing rules, refund policy and cancellation process apply. Prices, availability, plans and offers may change at any time. Virtual items, in-game currency and unlockable content are licensed to you for use within the product, have no monetary value, cannot be exchanged for money, and may be modified or discontinued as described below.

Third-party platforms and services

The Services may depend on or link to third-party stores, devices, networks and services that we do not control. Their terms and policies apply to them, and we are not responsible for their availability, content or conduct.

Availability and changes to the Services

We may add, change, suspend, limit, discontinue or replace any feature, product or the entire Services, in whole or in part, at any time and without liability to you. We do not promise that the Services will be available at any particular time, will be uninterrupted or error free, or that any feature, content, server, online functionality or product will remain available in the future.

Disclaimer of warranties

The Services are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted or secure operation, or that defects will be corrected. You use the Services at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have under mandatory consumer law.

Limitation of liability

To the fullest extent permitted by law, Robokick will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill, progress, purchases, virtual items or other intangible losses, arising out of or related to the Services, including outages, downtime, bugs, data loss, failures of third parties, interruption or discontinuation of any feature or product, whether based on warranty, contract, tort or any other legal theory, and whether or not we were advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed the amount you paid us for the product giving rise to the claim in the twelve months before the event, or the equivalent of ten United States dollars if you paid nothing.

Health and safety

Some of our products are played in virtual reality or use motion, sound and flashing imagery. Follow the health and safety guidance of your device manufacturer, play in a clear space, take regular breaks, and stop if you feel discomfort.

Indemnity

You agree to indemnify and hold Robokick harmless from claims, damages, losses and expenses arising from your misuse of the Services, your content, or your breach of these Terms or of applicable law.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue a product. The sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and indemnity, will continue to apply.

Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed, and continuing to use the Services after an update means you accept the revised Terms.

General

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and Robokick regarding the Services, and any additional rules of a store or platform you use apply alongside them.
